Man on probation for murder now charged with gun possession

An Addison man who was released on parole for first-degree murder is now charged with possessing a loaded submachine gun, officials said.

Edgar Martinez, 29, of the 800 block of South Addison Road, is charged with unlawful use of a weapon, armed violence, resisting a police officer causing injury, possession of cannabis with intent to distribute and unlawful possession of a controlled substance.

DuPage County Judge Leah Bendik ordered his detention on Friday.

DuPage prosecutors said agents from a U.S. Marshals task force were watching Martinez’s apartment at 11:10 a.m. Thursday because he had failed to contact his parole officer.

Federal agents saw him walk away with a black backpack and get into a ride-share vehicle. Agents stopped him and Martinez ran, leaving the backpack behind, according to law enforcement officials. Inside the backpack, they found a loaded Glock 17 9mm pistol with a switch that allowed it to fire in full-automatic mode and an extended 24-round magazine, according to a news release from the DuPage District Attorney’s Office.

The agents also found 270 grams of cannabis, 55 grams of cannabis flowers and 25 grams of cocaine, the press release said.

One agent suffered head and elbow injuries during the arrest.

Martinez was convicted of second-degree murder in a 2015 Cook County case and sentenced to 18 years in prison. He was eligible for parole in August 2023.

In a motion for remand, prosecutors say Martinez carried the gun for protection because he feared the brothers of the man he killed were after him.

Martinez’s next court date is scheduled for July 22.
